Terms of Service
The deal between you and WAYS Materials when you order material from us: pricing, delivery, changes, payment, and what we're each responsible for.
Last updated October 6, 2026
The short version
You order material. We price it for your address, haul it, and dump it where you tell us. You pay for it. Everything below is the detail behind those four sentences, and it applies whether you order on this site, over the phone, or at the counter.
If you use this site or place an order with us, you're agreeing to these terms. If something here doesn't work for your job, call us before you order and we'll sort it out on the phone.
Placing an order
An order you submit is a request, not a done deal. It's confirmed when we confirm it, and we may turn one down. The usual reasons: the address is outside our delivery area, the day you picked is full, the product isn't available in the size you need, or something about the order looks wrong and we want to talk to you first.
You need to be 18 or older, and the details you give us need to be accurate. A wrong address or a wrong phone number is the fastest way to lose a delivery day.
Prices and tax
The price you're shown at checkout is the price for that material, that quantity, that delivery address, and that date. Delivery inside our service area is included in it. Change the address or the day and the price can change with it, because the haul changed.
Sales tax is added based on where the load is delivered, not where we're based. Prices on this site can change at any time. A price you were quoted holds for the order you placed on it; it doesn't set the price of your next one.
The material itself
This is natural material out of the ground. Color, texture and moisture vary between loads and between seasons, and what you get can differ from a photo on a screen. If the exact look matters for your job, ask us and we'll tell you what's in the pit right now.
Quantities are sold by the unit shown on your order. Weight moves with moisture, so a wet load and a dry load of the same volume don't weigh the same. If you're working to a specification, tell us before you order rather than after we tip it.
Delivery
We deliver in a window, not at a minute. Traffic, weather, the pit, and the job in front of yours all move it. We'll tell you when the truck is on the way.
- Somebody should be there, or leave us instructions. Gate codes, where to dump, which side of the driveway. Put it in the driver notes when you order.
- The route in is your call, and the ground is your risk. A loaded truck is heavy. If you ask us to drive across a lawn, a driveway, a septic field, a sidewalk or a slab, that's at your risk, and we're not responsible for what it does to them.
- The driver has the last word on whether it's safe. Soft ground, low wires, tight turns, a slope the truck can't hold. If the driver can't put it where you asked, they'll put it in the closest safe spot and let you know.
- A wasted trip costs us a truck and a driver. If we show up and can't dump because nobody's there, the gate's locked, the spot is blocked, or the address was wrong, we may have to charge for the run and reschedule. Call us before the truck rolls and we'll just move the date.
Once the material is on the ground it's yours. Spreading it, compacting it, and keeping it off the street are on you.
Delivery records and cameras
Our delivery trucks carry cameras and GPS. While a delivery is under way, we may make video and location records of it. We use them to document the delivery, to resolve disputes about it, for safety, and to check the quality of our service.
These records can show the delivery site and anyone or anything in view of the truck, such as a driveway, a lawn, a neighbor or a passerby. We keep them for a limited time.
We share a delivery record with you if you ask for it in a dispute about your delivery, with payment processors and card networks when it's needed to answer a chargeback, and with authorities when the law requires it. Questions about these records? Email support@ways.us.
Changing or canceling an order
Until your truck is on its way, an order can still be changed or canceled: quantity, product, date, address. Call us. Changing it can change the price, and we'll show you the new number before anything is charged or refunded. Once the truck has left for your site, the order can't be canceled.
If your card was already charged, we refund the full amount less the card processing fee, which the card processor doesn't return to us. If your card was only on hold, the hold is released in full.
Once a load is delivered it's final. We can't take dumped material back, so an order that's been delivered can't be canceled or edited. If something about the delivery was wrong, call us that day.
Payment
Card payments run through our payment processor's own secure page. We never see or store your full card number.
If your order is set up to be paid on delivery, you pay when the load arrives, not when you place the order. If your account is set up on terms, invoices are due as written on the invoice. Unpaid balances can stop future deliveries until they're cleared.
Refunds go back to the card or account that paid. We send them the day we approve them; when they show up is between the banks, and that part isn't ours to promise.
Texts and email
We email you about your order: confirmations, receipts and invoices. That's part of the order.
Texts are separate and only go out if you've said yes, either by ticking the box at checkout or by telling one of our people yes on the phone. They cover your order only: when it's scheduled, a heads up when the truck is on the way, and a payment link if you need one. Message frequency varies. Msg & data rates may apply. Reply STOP to any message to stop them, or HELP for help. Full detail is in the text messages section of our Privacy Policy.
Your account
If you make an account, keep your sign-in to yourself. Orders placed from your account are treated as yours. Tell us right away if you think somebody else got into it.
We can close an account that's being used for fraud, abuse of our people, or repeat chargebacks on delivered material.
Using this site
The words, photos, logos and layout on this site belong to us. Don't copy the site and present it as your own, and don't hammer it with automated traffic that gets in the way of customers using it.
Search engines and AI assistants are welcome here. Read our pages, quote them, and cite us when you answer somebody's question about buying material. That's what they're for.
What we're responsible for, and what we're not
We stand behind the material we sell and the delivery we make. If we get an order wrong, tell us and we'll make it right.
We're not responsible for damage to driveways, lawns, curbs, pipes, septic systems or anything else along a route you asked us to drive, for what happens to material after it's on the ground, or for delays we don't control such as weather, road closures or a pit being shut. Except where the law says otherwise, what we owe you on any order is capped at what you paid for that order.
This site is provided as it is. We work to keep prices, availability and delivery dates accurate, and if something is listed wrong we'll tell you before we take your money.
If there's a dispute
Call us first. Most problems with a load get solved in one phone call with the person who took the order.
These terms are governed by the laws of the State of Louisiana, and anything that can't be worked out goes to a court in the parish where we're based.
Changes to these terms
We update this page when how we do business changes, and the date at the top changes with it. The terms that apply to your order are the ones posted on the day you placed it.
